  1. END-USER LICENSE AGREEMENT FOR 
  2. KAOS KONTROL GENOCIDE
  3.  
  4. IMPORTANT READ CAREFULLY: This Kaos Kontrol End-User 
  5. License Agreement (EULA) is a legal agreement between you
  6. (either an individual or a single entity) and Kaos Kontrol for
  7. the Kaos Kontrol software product identified above, which includes 
  8. computer software and associated media and printed materials 
  9. (if any), and may include online or electronic documentation 
  10. (SOFTWARE PRODUCT or SOFTWARE). By installing, copying, 
  11. or otherwise using the SOFTWARE PRODUCT, you agree to be 
  12. bound by the terms of this EULA. If you do not agree to the terms
  13. of this Agreement, you are not authorised to use the
  14. SOFTWARE PRODUCT.

  16. The SOFTWARE PRODUCT is protected by copyright laws and 
  17. international copyright treaties, as well as other intellectual
  18. property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
  19.  
  20. 1. GRANT OF LICENSE. EULA grants you the following rights:
  21. For Full/Registered Version of the Software:        
  22.     Use and Copy. Kaos Kontrol grants to you the right to use copies 
  23. of the SOFTWARE PRODUCT only on one computer.  You may also 
  24. make copies of the SOFTWARE PRODUCT for backup and archival 
  25. purposes.
  26. For Trial/Compatibility Demo Version of the Software:        
  27.     Use and Copy. Kaos Kontrol grants to you the right to use copies 
  28. of the SOFTWARE PRODUCT on an unlimited number of computers.  
  29. You may also make copies of the SOFTWARE PRODUCT for backup and
  30. archival purposes. You may copy and/or distribute the
  31. SOFTWARE PRODUCT freely as long as no kind of financial payment
  32. is charged for it. You may not alter, add, or remove any files
  33. from the distribution package.

  35. The SOFTWARE PRODUCT and all contained images, sound, video,
  36. logos and insignias are Copyright (c)1997-1998 Kaos Kontrol.
  37. All Rights Reserved.

  39. 2.  RESTRICTIONS.
  40. -You must maintain all copyright notices on all copies of the 
  41. SOFTWARE PRODUCT. The SOFTWARE
  42. PRODUCT may be designed not to function if any of the copyright 
  43. notices are removed or altered.   
  44. -You may not distribute copies of the SOFTWARE PRODUCT to 
  45. third parties, except in case of the Trial/Compatibility Demo.
  46. -You may not reverse engineer, decompile, or disassemble the 
  47. SOFTWARE PRODUCT, except and only to the extent that such 
  48. activity is expressly permitted by applicable law notwithstanding this 
  49. limitation.
  50. -You may not rent or lease the SOFTWARE PRODUCT. 
  51. -You may permanently transfer all of your rights under this EULA 
  52. only in conjunction with a permanent transfer of your validly licensed 
  53. copy or copies of Kaos Kontrol product(s).
  54.  
  55. 3.  TERMINATION. Your rights under this EULA terminate upon 
  56. the termination of your Kaos Kontrol software EULA, or 
  57. without prejudice to any other rights, Kaos Kontrol may terminate 
  58. this EULA if you fail to comply with the terms and conditions of this 
  59. EULA. In such event, you must destroy all copies of the SOFTWARE 
  60. PRODUCT.

  62. 4.  COPYRIGHT. All title and copyrights in and to the SOFTWARE 
  63. PRODUCT and any copies thereof are owned by Kaos Kontrol or its 
  64. suppliers. All title and intellectual property rights in and to the 
  65. content which may be accessed through use of the SOFTWARE 
  66. PRODUCT is the property of the respective content owner and may 
  67. be protected by applicable copyright or other intellectual property 
  68. laws and treaties.  This EULA grants you no rights to use such 
  69. content.

  71. 5.  U.S. GOVERNMENT RESTRICTED RIGHTS.
  72. The SOFTWARE PRODUCT is provided with RESTRICTED 
  73. RIGHTS. Use, duplication, or disclosure by the Government is 
  74. subject to restrictions as set forth in subparagraph (c)(1)(ii) of the 
  75. Rights in Technical Data and Computer Software clause at DFARS 
  76. 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial 
  77. Computer Software Restricted Rights at 48 CFR 52.227-19, as 
  78. applicable.

  80. 6.  NO WARRANTY. ANY USE OF THE SOFTWARE PRODUCT 
  81. IS AT YOUR OWN RISK. TO THE MAXIMUM 
  82. EXTENT PERMITTED BY APPLICABLE LAW, KAOS 
  83. KONTROL AND ITS SUPPLIERS DISCLAIM ALL 
  84. WARRANTIES AND CONDITIONS, EITHER EXPRESS OR 
  85. IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED 
  86. WARRANTIES OF MERCHANTABILITY, FITNESS FOR A 
  87. PARTICULAR PURPOSE, AND NONINFRINGEMENT.

  89. 7.  NO LIABILITY FOR CONSEQUENTIAL DAMAGES.
  90. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE 
  91. LAW, IN NO EVENT SHALL KAOS KONTROL OR ITS 
  92. SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, 
  93. INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER 
  94. (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS 
  95. OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF 
  96. BUSINESS INFORMATION, OR ANY OTHER PECUNIARY 
  97. LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE 
  98. THE SOFTWARE PRODUCT, EVEN IF KAOS KONTROL HAS 
  99. BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  
  100. BECAUSE SOME STATES AND JURISDICTIONS DO NOT 
  101. ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY 
  102. FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE 
  103. ABOVE LIMITATION MAY NOT APPLY TO YOU.

  105. 8.  LIMITATION OF LIABILITY.  KAOS KONTROL'S ENTIRE 
  106. LIABILITY AND YOUR EXCLUSIVE REMEDY UNDER THIS 
  107. EULA SHALL NOT EXCEED FIVE DOLLARS (US$5.00).

  109. 9.  MISCELLANEOUS
  110. This EULA is governed by the laws of the United States of America 
  111. and other countries.
